REGULATIONS FOR THE USE OF DE MARCO'S SERVICES OF June 19, 2019.

CHAPTER I – GENERAL PROVISIONS
§ 1.
1. De Marco products can be purchased in the stationary store 34-108 Frydrychowice ul. Centralna 59 and in online stores. Online orders can be placed on the following websites: sklep.demarco.pl/pl/, olx.pl, lento.pl, gumtree.pl/przedmy.pl and others.
2. The De Marco brand belongs to Władysława Frączek, running a business under the name PPHU De Marco Władysława Frączek, Frydrychowice ul. Centralna 59, 34-108 Frydrychowice, tel.: (+48) 33 879 59 13, (+48) 502 142 267, e - mail: wf.info.demarco@gmail.com, info@demarco.pl.
3. The scope of activity of the De Marco company is the production of exclusive women's clothing, design and sewing to individual customer orders, tailoring, tailoring of hotel and restaurant clothing, wholesale and retail trade in clothing, as well as online sales.
4. Clothing offered on websites is updated.
5. The company undertakes to deliver the customer a complete, undamaged product consistent with the description within the agreed time.
6. The company sells throughout the country and the world.
7. The Regulations specify the conditions for concluding sales contracts as well as the complaint procedure.
8. All product prices posted on the websites are given in Polish zloty including VAT.
9. We send fabric samples for a fee at the customer's individual request.
CHAPTER II – DEFINITIONS
§ 2.
Definitions of individual names used in the regulations:
1. Stationary store - means the headquarters of De Marco, located in Frydrychowice, where you can purchase products directly.
2. Online store – these are websites where you can purchase De Marco products. The online store allows customers to conclude sales contracts remotely.
3. Customer – any organizational or legal entity that uses the services offered by the company.
4. Product – a finished product (clothing) offered by De Marco for retail, wholesale or online sale.
5. Working day – one day from Monday to Friday, excluding public holidays.
6. Price – is placed next to the products. The given price is a gross price, it does not include the costs of delivering the products.
7. Supplier – a courier company or public operator (Poczta Polska) that cooperates with De Marco.
8. Cost of delivering the product - this is the amount the customer pays for delivering the product.
9. Order – means placing an order by the customer for a product or products in a stationary or online store in accordance with these regulations.
10. Application form – In the case of tailoring, please complete the form at demarco.pl/formularz. By completing the form, the customer undertakes to pay 50% of the product price as an advance payment.
CHAPTER III - ACCEPTANCE AND IMPLEMENTATION OF ORDERS
§ 3.
By placing an order, the customer declares that:
1. He has read and accepted the content of these regulations.
2. He has read the terms and conditions of placing an order.
3. Read the instructions for washing clothes.
4. He has read the complaints and returns regulations.
§ 4.
1. The stationary store is open from Monday to Friday from 9:00 a.m. to 4:00 p.m. The address is specified in §1.1 of these regulations.
2. Online stores are available to customers 7 days a week, 24 hours a day.
3. In the case of purchasing finished products (not made to order), the sales contract between the customer and the seller is concluded upon placing the order and making the payment.
4. In the case of tailoring, the order is accepted after completing the form on the website demarco.pl/formularz or in the online store and paying an advance payment of 50% of the product price.
§ 5.
1. The customer can buy De Marco products in a stationary store or online stores.
2. The customer using the "Tailor-made" service is obliged to fill out the form on the website demarco.pl/formularz. You can also contact the seller via e-mail: wf.info.demarco@gmail.com, info@demarco.pl or by phone: +48 502 142 267, +48 33 879 59 13. 3. Online stores accept orders 24 hours a day, every day of the year.
4. Orders placed on non-working days will be processed on the first business day following the day on which the order was placed.
5. The goods covered by the order are delivered to the customer by the seller together with a document confirming the conclusion of the sales contract, i.e. a fiscal receipt or a VAT invoice if the ordering party requested its issuance when placing the order and provided the necessary data for its issuance.
6. After placing an order online, the seller will contact the customer by phone or e-mail to discuss the details of the order.
§ 6.
1. De Marco reserves the right to delete unpaid orders in which the customer's personal data is incorrect or makes it impossible to contact the customer.
2. The De Marco company reserves the right that in the event of a change in body dimensions, the customer will bear the consequences. In such a situation, the company does not accept returns.
3. De Marco reserves the right not to accept the order or to interrupt the execution if the customer shows bad intentions, his actions suggest an attempt at extortion or acts to the detriment of the brand.
4. The De Marco company reserves the right that there may be differences in the shade of colors in the photo due to the white balance setting and color settings on the monitor.
5. Orders not paid within 5 days of placing the order are canceled by the seller and the contract is considered void.
6. The customer has the right to cancel the order before making payment. In this case, the customer should immediately contact the seller by phone and e-mail.
7. In the case of the "Tailor-made" service, the order is accepted after paying a 50% advance payment, the remaining amount must be paid just before the product is shipped.
8. Hygiene products (cotton masks) are not returnable.
CHAPTER IV - PAYMENTS
§ 7.
1. Payment methods are specified in these regulations and when placing an order.
2. De Marco provides the following payment methods for purchases:
a) In a stationary store, payment in cash (Address is specified in §1.1 of these regulations).
b) Traditional transfer in the online store (payment to account or cash on delivery).

CHAPTER V – DELIVERY OF CLOTHING
§ 8.
1. The customer has the right to choose the method of delivering the clothing from among the options proposed by the seller when placing the order:
a) Personal collection (Address is specified in §1.1 of these regulations)
b) Foreign shipment Poczta Polska
c) Courier delivery
2. The order completion date in the online store is available in the description of the selected auction and when placing the order. The deadline is given in working days.
a) In case of ordering finished products: up to 4 business days when choosing courier delivery, up to 10 business days when choosing shipping abroad
b) In the case of the "Tailor-made" service, from 5 weeks to 8 weeks.
3. De Marco reserves the right to individually set an order completion date with the customer.
4. De Marco reserves the right to change the order completion date and will inform the customer each time.
5. The delivery fee for products is included when placing an order, in the online store, at auctions and in these Regulations.
a) Courier shipment – in accordance with the carrier's rate
b) Cash on delivery courier shipment – in accordance with the carrier's rate
c) Foreign courier shipment – approx. PLN 150 (depending on the time zone) – Poczta Polska
6. The number of ordered products does not affect the delivery cost, which is unchanged.
7. In the case of shipment not included in these regulations, the shipment is priced individually.
§ 9.
1. If the customer fails to collect the ordered and paid product, De Marco, after contacting the customer, may:
a) Reship the product for a repeat shipping cost
2. The De Marco company informs that in the event of damage to the shipment during transport, the customer, in accordance with the Transport Law Act of November 15, 1984 (Journal of Laws of 1984, No. 53, item 272, as amended), has the right to requesting the supplier to prepare a damage report if the supplier does not prepare a damage report on its own initiative. When the customer receives a damage report from the supplier, De Marco recommends sending this document (or a copy thereof) to the correspondence address (specified in §1.1 of these regulations), which will contribute to faster consideration of the submitted complaint.
CHAPTER VI – DESIGNING AND MADE TO MEASURE. INDIVIDUAL MEETINGS AND CONSULTATIONS WITH CLOTHING DESIGNER WŁADYSŁAWA FRĄCZEK
§ 10.
1. A meeting with a clothing designer must be made by phone or electronically (specified in §1.2. of these regulations).
2. Styling and advice are included in the price of the outfit at the time of order.
3. If the client decides not to order a creation, the meeting with the designer is subject to a fee of PLN 200 for each commenced hour.
4. The order completion date is agreed individually and directly with the fashion designer.
5. A customer who decides to order a tailor-made outfit undertakes to pay an advance payment of 50% of the value of the outfit.
6. The De Marco company reserves the right that if the customer does not collect the creation (random situations), it will not refund the advance payment, it will be used as partial costs incurred by the company.
7. The customer who comes for the first measurement and fitting undertakes to wear the underwear that he or she intends to wear with this outfit on the day of the ceremony (slimming underwear, slimming belts, push up underwear - bras, panties).
8. The client is obliged to inform about planned diets or surgeries to improve the figure.
9. The De Marco company reserves the right that in the event of a change in body dimensions, the customer will bear the consequences. The company has the right to charge the customer additional costs for having the garment reworked.
10. Any changes during the execution of the order may result in an increase in the original creation cost.
11. During a fitting or meeting with a fashion designer, we kindly ask you not to talk by phone.
CHAPTER VII – RIGHT TO WITHDRAW FROM THE CONTRACT
§ 11.
1. The customer who is a consumer has the right to withdraw from the contract without giving a reason and undertakes to return the products on the next business day from the date of receipt of the products to the correspondence address of De Marco (specified in §1.1 of these regulations).
2. Pursuant to Art. 38 points 3 of the Act of May 30, 2014 on consumer rights (Journal of Laws 2014, item 827, as amended), the consumer is not entitled to withdraw from the contract if the ordered product is prepared according to the consumer's individual specifications ("Sewing on made-to-measure", service of "processing to the consumer's dimensions"). In exceptional situations, the company may reach a settlement, the processed product is accepted with a refund of the payment after deducting the costs of processing and the acceptance of a product with non-standard dimensions.
3. Return of goods is possible only if the product is in unchanged condition and shows no signs of use.
4. The return (withdrawal from the contract) form is available in the annex to these Regulations.
5. The De Marco company returns the amount paid by the consumer as payment (product price) within 14 days from the date of withdrawal by the consumer from the contract or immediately after receiving the returned product, using the same method of payment as used by the consumer. Shipping costs are not refunded.
6. For orders of more than one item of product, if the consumer returns only part of the order, De Marco returns the amount paid to the consumer for the returned product.
7. In order to meet the deadline referred to in §11.5 of these regulations, it is sufficient to send to De Marco, before its expiry, a declaration of withdrawal from the contract in writing to the correspondence address of De Marco (specified in §1.1 of these regulations) or electronically by sending the form by e-mail to the e-mail address: info@demarco.pl. The consumer may use the sample declaration of withdrawal from the contract, which constitutes an annex to these regulations. If you withdraw from the contract electronically, please enter "RETURN" in the subject of the e-mail.
8. After receiving the consumer's declaration of withdrawal from the concluded contract, De Marco will contact the consumer by telephone or electronically.
9. De Marco informs that it does not have a policy of sending multiple outfits: to be tried on, looked at, selected and "tested". Ready-made designs can be viewed and tried on during a visit to the De Marco Fashion Salon in Frydrychowice after prior arrangement.
10. Hygiene products (cotton masks) are not returnable.
CHAPTER VIII – COMPLAINT PROCEDURE
§ 11.
1. The customer should submit a complaint in writing to the correspondence address of De Marco (specified in §1.1 of these regulations) or by e-mail to the e-mail address: info@demarco.pl.
2. If you submit a complaint electronically, please enter "COMPLAINT" in the subject of the e-mail.
3. The De Marco company is liable to the consumer for the non-compliance of the product with the sales contract to the extent specified in the provisions of the Civil Code (Journal of Laws of 1964, No. 16, item 93, as amended).
4. Before the consumer submits a complaint, it is recommended to contact De Marco by phone at (+48) 33 879 59 13, (+48) 502 142 267 or by e-mail at info@demarco.pl
5. The Seller will consider the complaint within 14 days of the customer returning the product.
6. After contacting De Marco, the complained product should be sent to the correspondence address of De Marco (specified in §1.1 of these regulations).
7. If the product has a defect, De Marco will immediately replace the damaged product with a defect-free one or remove the defect. If the product cannot be repaired or replaced, the consumer may submit a declaration of price reduction or withdrawal from the contract.
8. If the consumer's complaint is considered positively, the costs of the complaint are borne by De Marco.
9. If the complaint is rejected, the shipping costs are covered by the consumer.
CHAPTER IX – PERSONAL DATA PROTECTION
§ 12.
1. De Marco, as the administrator of personal data, protects customers' personal data.

3. The data provided by the Customer may be processed only for the purposes specified in these regulations.
4. The customer consents to the processing of his personal data contained in the order form, i.e. name and surname, e-mail address, telephone number, address or company name and NIP (Tax Identification Number) by the Administrator
5. The consent granted applies to data processing only for the purpose of concluding a contract between the client and De Marco.
6. The customer declares that he has been informed about the right to access his data and the right to correct it, as well as the right to withdraw consent to the processing of personal data at any time and that all personal data was provided by the customer voluntarily.
7. The personal data provided by the customer will be protected by De Marco with the utmost care.
8. The customer agrees to receive commercial information regarding the services provided by De Marco to the e-mail address provided in accordance with the Act of July 18, 2002 on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended). later amended).
9. We implement the provisions of the GDPR - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.
CHAPTER X – COOKIES POLICY
§ 13.
1. The demarco.pl website uses "cookies". The information contained in cookies is used for advertising and statistical purposes and to adapt our websites to individual customer needs. Each customer has the right to change cookie settings in his browser. If the settings remain unchanged, cookies will be saved in the device's memory. Attention! Changing cookie settings may limit the functioning of the website.
CHAPTER XI – COPYRIGHTS
§ 14.
1. All photos, graphics, texts, signs and logos are subject to legal protection under the Copyright Act. They cannot be used for any purposes, including marketing, without the consent of the company owner. (Journal of Laws 1994, No. 24, item 83, Art. 8.1 - Copyright belongs to the author, unless the Act provides otherwise).
CHAPTER XII – FINAL PROVISIONS
§ 15.
1. Any misunderstandings that may arise during the implementation of the sales contract and all claims will be dealt with first of all amicably and in the complaint procedure.
2. In matters not regulated in these Regulations, the provisions of the Civil Code shall apply.
3. In the event that any of the provisions of these regulations may become invalid, the remaining provisions shall remain valid. In such a case, De Marco will replace the invalid provision of the regulations with another legally indisputable provision that clearly reflects the intended purpose of the unclear provision.
4. These regulations may be changed without giving reasons.
5. Changes will be immediately published in the form of a consolidated text of the regulations along with information about them.
6. These regulations enter into force on the day of their publication on the website.
§16.
1. The Regulations contain the following annexes:
a) Sample declaration of withdrawal from the contract between the customer and De Marco (Goods return form)

Pursuant to Article 8 of the Act of July 27, 2002 on special conditions of consumer sales and amending the Civil Code (Journal of Laws of 2002, No. 141, item 1176, as amended):

a) free repair,

In cases where:
a) repair or replacement is impossible or requires excessive costs,
b) replacement or repair would expose the complainant to significant inconvenience,

The complainant may demand an appropriate price reduction or withdraw from the contract, i.e. demand a refund of the price paid.
You cannot withdraw from the contract if the non-conformity of the goods with the contract is immaterial.
It is recommended to prepare the complaint in two copies. Leave one copy in the store. The second one should be signed and dated by the person receiving the letter. The time in which the seller responds to the complaint is counted from the date of receipt of the complaint. You can also send a complaint by registered letter with acknowledgment of receipt, or electronically. The seller has 14 days to consider the complaint request.

CLOTHES WASHING INSTRUCTIONS
1. We fasten all zippers and buttons.
2. Clothes should be turned inside out.
3. We use mild detergents, wool washing liquids and delicate fabrics.
4. WE DO NOT APPLY: soaking clothes before washing, soaking clothes and leaving them to wait overnight, etc.
5. Clothes can be washed by hand or in automatic washing machines on a program for washing wool and delicate fabrics.
6. Washing temperature 30 - 40 degrees C.
7. Do not use chlorine.
8. Do not use bleach.
9. Do not use detergents.
10. The use of color catching wipes is recommended.
11. Recommended rinsing with vinegar (final rinse).
12. Do not spin.
13. Dry hanging on clothes hangers, the clothes should be smoothed and shaped neatly on the hanger.
14. Can be dried flat on towels.
WASHING RECIPES FOR TWO-COLORED CREATIONS
Hand washing: water temperature 30 degrees (summer), we use liquid for washing delicate fabrics and wool. Vinegar should be added to the water (it can be spirit-based). You should also use wipes that catch color and help remove dirt, e.g. "Dr.Beckmann". Rinse in lukewarm water with vinegar. Wash without prior soaking. Spin gently and hang on a hanger to dry.
Washing in an automatic washing machine: select the delicate or hand wash program, put the clothes in a pillowcase with a zipper and also put wipes that catch color and help remove dirt, e.g. "Dr.Beckmann". Water temperature 30 degrees, we use liquid for washing delicate fabrics and wool. Vinegar should be added to the water (it can be spirit-based). Add vinegar to the rinse (last rinse). Wash without prior soaking. Spin gently and hang on a hanger to dry.
